Formal complaint.
I would like to formally request an investigation into the actions of the Kansas University's police departments actions regarding an Investigation involving the Yellow House Store headed by Detective Michael Riner.

Perjury, Theft, Violation of 5th Amendment rights, Conspiracy, Execution of a Federal arrest in a State case Investigation absent of Federal charges or Jurisdiction. Attempt to Falsly frame defendants.

On Thursday August 8th Detective Mike Riner came into our business The Yellow House store, 1904 Massachusetts, Lawrence Kansas. (A business that buys and sells second hand goods.) Because a Laptop computer that our business was selling on Ebay had been reported stolen by an employee of the University of Kansas.

We turned over the Laptop and showed Detective Riner the form that the customer "Robert Samples" had filled out. Detective Riner was shown two sellers forms, including the one that Mr. Samples signed when selling the Laptop in question. He took notes from both the sellers forms and left. While taking the notes Detective Riner verbally questioned the fact that 3 laptops were listed on the sellers form and when shown the second sellers form commented "that there was a pattern here."

On Friday at appx. 10:30AM August 9th Detective Riner returned to the Yellow House Store with a reciept for the siezed laptop and requested copies of the sellers forms that Mr. Samples had signed.

At that time Mr. Neighbors Attorney had not been notified of his contact with the police, and due to a pending indictment involving another case felt it would be best to have representation of counsel.
At that point Mr. Neighbors invoked his Fifth Amendment right and requested that he wait until Monday when he could go through his attorney to turn over the paperwork or answer any more questions. Two hours later at appx. 4pm the Postal Inspector David Nitz, Police Officer Jay Bialek, Detective Riner and other officers from KU Police and LKPD showed up at the business with a Federal arrest warrant and search warrant.

After the search warrant was executed the store surveillance tape was stolen by the police and a blank tape was put in its place. The Neighbors were arrested on a Federal warrant Even though this was a State case that involved a Laptop stolen from the University and being investigated by University police and did not qualify as a Federal case.At no time during the arrest were we read our Miranda rights.

This arrest has denied and punished us for demanding our Constitutional right to have counsel present when being questioned by police. This resulted in both Guy and Carrie Neighbors being locked up for a total of 12 days. Starting in Douglas County Jail, and transferred to the CCA Leavenworth Detention Center. Guys attorney was not even notified until after the arrest.

The allegation has bounced from being Obstruction of Justice and then went to concealment of a document, clearly showing a conspiracy to decieve the courts. Detective Riner falsly testified in perjured testimony during the hearing in Federal Court before Judge O'Hara that he was never shown the document. However the Thursday store survelliance video clearly shows that the Detective was shown the documents and took notes on a yellow legal pad.

When the defendants stated that he had taken notes from the document, the Detective claimed to have destroyed those notes in the shredder. When we presented the document we were accused by the Prosecutor of presenting a forged document to the courts. Even though the document in question was clearly signed by Robert Samples and we are not legally mandated by law to even fill out these forms in the first place. So there was never a motive for the defendants in this case to lie or present a false document!
